警方曾就當日民陣於金鐘舉辦的和平集會發出不反對通知書，而事發地點龍匯道南面行人路屬不反對通知書範圍之內。但警方依然在中信大廈外使用催淚彈清場，而且施放前沒有作任何警告。從影片1分33秒處可見，中信大廈外左方有警員發射催淚彈。。由於右方設有警方防線，示威者只能走入中信大廈，沒有其他通道離開。

示威者已撤退，未有攻擊或衝擊警方防線行為，但在影片44秒，警方仍向人群施放催淚彈。涉嫌違反《公安條例》第17條中，表明警務人員在阻止公眾聚集舉行，或停止或解散公眾聚集時，只可以使用「合理所需的武力」。
